1. Acceptance of Terms
By accessing or using The Listeners website (thelisteners.co) and its services (the “Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service.

2. Description of Service
The Listeners provides a space for active, non-judgmental listening sessions. The Service consists of scheduled conversations where a listener provides their full attention. The Service is not therapy, counseling, coaching, or crisis intervention.

3. No Therapeutic Relationship
You acknowledge and agree that:

  • No therapist-patient, counselor-client, or any other professional relationship is created through your use of the Service.
  • The Listeners does not diagnose, treat, or provide medical or psychological advice.
  • You are solely responsible for your own mental and emotional well-being.

4. User Conduct & Prohibited Topics
You agree to use the Service for lawful purposes only. The following topics are strictly prohibited during any session:

  • Planning, describing, or encouraging any illegal activity.
  • Threats of physical harm or violence toward yourself or any other person.
  • Any form of abuse, harassment, discrimination, or hate speech.
  • Discussions involving child exploitation, terrorism, or any other criminal activity.

Consequences of Violation:
If any prohibited topic arises during a session:

  1. The listener will pause the conversation and remind you of this policy.
  2. If the topic persists, the session will be ended immediately.
  3. No refund will be issued for sessions terminated due to policy violations.
  4. The Listeners reserves the right to contact local authorities if we believe there is an imminent risk of harm.

5. Booking, Payments, and Cancellations

  • Booking: All sessions must be booked in advance through our website.
  • Payments: Payment is required at the time of booking. All fees are non-refundable except as expressly provided in these Terms.
  • Cancellations: You may cancel or reschedule a session up to [e.g., 24 hours] before the scheduled time. Cancellations made after this period may not be eligible for a refund.
  • No-Show: If you do not join the session within [e.g., 10 minutes] of the scheduled start time, the session will be considered a no-show and no refund will be issued.

6. Limitation of Liability
To the fullest extent permitted by law, The Listeners and its representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the Service.
  • Any conduct or content of any third party on the Service.
  • Unauthorized access, use, or alteration of your transmissions or content.

7. Indemnification
You agree to defend, indemnify, and hold harmless The Listeners and its representatives from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:

  • Your use of and access to the Service.
  • Your violation of any term of these Terms.
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
  • Any claim that your content caused damage to a third party.

8. Termination
We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
